TERMS AND CONDITIONS OF SALE

 

 

1. Application of Terms

1.1 These Terms apply to all goods and services supplied by Grand Glass & Hardware Ltd (“Grand Glass”).
1.2 Acceptance of a quotation, payment of a deposit, or placement of an order constitutes acceptance of these Terms.
1.3 Grand Glass may amend these Terms at any time. The Terms in force at the date of quotation or order acceptance apply.

2. Quotations and Payment

2.1 Quotations are valid for 14 days unless otherwise stated.
2.2 Prices are estimates and may change due to final measurements, specifications, materials, or site conditions.
2.3 Installation pricing is subject to full site measurement and inspection, with any variations advised before work proceeds.

Payment Terms

  • 50% deposit upon acceptance
  • Supply only: full payment before dispatch
  • Supply & install: balance due immediately upon completion

3. Ownership, Security Interest, and Default

3.1 Ownership of goods remains with Grand Glass until full payment is received.
3.2 The Customer grants Grand Glass a security interest in supplied goods and proceeds until paid in full.
3.3 Where payment is overdue, Grand Glass may, upon reasonable notice and in a lawful and peaceful manner, repossess unpaid goods to the extent permitted by New Zealand law.
3.4 Interest of 2.5% per month (calculated daily) applies to overdue amounts.
3.5 The Customer is liable for all recovery costs, including administration, debt collection, and legal costs on a solicitor-client basis.

4. Warranty

4.1 Warranty Periods

  • Glass: 15 years (manufacturing defects only)
  • Hardware: 5 years
  • Gate section hardware: 2 years
  • Aluminium components: 10 years
  • NANO coating (certified application): 10 years
  • Installation workmanship: 12 months

4.2 Remedy Limitation

If a defect is proven, Grand Glass will replace the product or refund the original material price only, at its discretion.
Grand Glass is not liable for installation costs, delays, or consequential loss.

4.3 Exclusions

Warranty does not apply where goods are modified, misused, incorrectly installed, poorly maintained, or damaged after supply.

4.4 Natural Material Characteristics

The warranty covers manufacturing defects only.
The following are natural characteristics and not defects:

  • Spontaneous breakage of toughened glass
  • Natural tea staining or surface discoloration of stainless steel
  • Normal aging, weathering, or environmental exposure

4.5 Installation Scope

Installation warranty applies only to Grand Glass workmanship.
Grand Glass is not responsible for:

  • Structural condition of the building or substrate
  • Waterproofing or building envelope performance
  • Council or regulatory compliance outside our direct scope
  • Third-party work or pre-existing site defects

Grand Glass bears no joint or consequential liability for these matters.

5. Producer Statements

5.1 Generic PS1: free of charge.
5.2 Site-specific PS1: $120 + GST.
5.3 PS3 and cover sheet issued after full payment for installation projects.

6. Delivery and Acceptance

6.1 Goods are deemed accepted upon delivery or collection.
6.2 Damage reported after acceptance is the Customer’s responsibility.

Freight Outside Auckland

  • Delivery time is not guaranteed.  
  • Clear, level, safe access is required
  • Price includes tail-lift only; HIAB or special equipments are at Customer`s cost

Auckland Van Delivery

  • Front-door drop-off only
  • Delivery may be cancelled if the site is unsafe
  • Customer must provide sufficient lifting assistance

7. Returns, Storage, and Glass Care

7.1 Non-fault returns incur a 15% restocking fee plus freight.
7.2 Freighted goods must be inspected within 3 days.

7.3 Glass must be stored in a dry, ventilated environment, protected from moisture and panel contact.
Improper storage may cause mould, staining, scratching, or surface damage.

7.4 Grand Glass accepts no responsibility for mould, staining, scratching, or similar damage reported more than one (1) month after delivery or caused by improper storage or handling.

7.5 Custom-made products and nano-coated glass are non-returnable.

8. Handling and Site Safety

8.1 Care must be taken when handling glass to prevent injury or breakage.
8.2 Broken toughened glass fragments may still cause cuts; appropriate PPE must be used.
8.3 Grand Glass is not liable for injury, loss, or damage caused after delivery due to mishandling or unsafe site conditions.
8.4 The Customer must ensure safe access, scaffolding, and installation conditions unless otherwise agreed.

9. Limitation of Liability

9.1 To the maximum extent permitted by New Zealand law, Grand Glass’s total liability under any contract is limited to the amount paid for the relevant goods or services.
9.2 Grand Glass is not liable for indirect, consequential, or economic loss, including loss of profit, delay costs, or third-party claims.

10. Consumer Guarantees Act and Business Customers

10.1 Where goods or services are acquired for business purposes, the parties agree that:

  • The supply is in trade; and
  • The Consumer Guarantees Act 1993 is contracted out of to the fullest extent permitted by law.

10.2 The parties confirm it is fair and reasonable to contract out, considering the commercial nature of the transaction, bargaining power, alternative suppliers, and opportunities for legal advice.

10.3 Where any non-excludable law applies, Grand Glass’s liability is limited to replacement, repair, or refund of the original purchase price, at its option.

11. Governing Law

11.1 These Terms are governed by the laws of New Zealand.
11.2 Disputes are subject to the exclusive jurisdiction of New Zealand courts.
